Kochi: The Kerala High Court on Monday granted bail to a doctor couple based in Kochi in a case registered by the Punjab police in connection with the offences under the Information Technology Act and Indian Penal Code.
The couple sought bail in the case registered by the Rajpura City Police in Punjab.
Justice K.T. Sankaran ordered that if Dr. K.A. Koshy and his wife Dr. Serene were arrested within two months on the basis of the warrant of the sub-divisional magistrate, Rajpura, Punjab, they should be released on bail on their executing a bond of Rs.25,000 each with two solvent sureties to the like sum to the satisfaction of the Ernakulam Chief Judicial Magistrate Court. The other conditions were; they should surrender passports if any; they should appear before the Kochi city police commissioner on the date intimated by the commissioner.
According to the Punjab Police, former employee and brother of Dr. Serene, Samdeep Mohan Varghese and other former employees of a Delhi-based company had created false and fictitious website and sent defamatory emails to its various clients. The accused had made huge losses to the company by taking away confidential data. The Punjab police had charged the doctor couple with colluding with the accused in defaming the company.
The court granted bail after holding it had the power to grant anticipatory bail in connection with the offences committed outside the jurisdiction of the High Court.
